Terms and Conditions

Brum & Keizer Dienstverlening, member of the NBBU

These terms and conditions apply to all services of Brum & Keizer Dienstverlening, located at Steenstraat 49A, 7571 BJ Oldenzaal. Brum & Keizer is a member of the NBBU (Dutch Association of Intermediary and Temporary Employment Agencies) and uses the NBBU terms and conditions as a basis.

Article 1 - Definitions

  • Contractor: Brum & Keizer Dienstverlening, the employment agency and intermediary.
  • Client: The natural or legal person who enters into an agreement with the Contractor.
  • Temporary worker: The employee who is made available to the Client by the Contractor.
  • Candidate: The person who is proposed by the Contractor in the context of recruitment and selection.
  • Agreement: Any agreement between Contractor and Client, including amendments and additions.

Article 2 - Applicability

  1. These general terms and conditions apply to all offers, quotations, agreements and service deliveries by Brum & Keizer Dienstverlening.
  2. Deviations from these terms and conditions are only valid if expressly agreed in writing.
  3. The applicability of any purchasing or other terms and conditions of the Client is explicitly rejected.
  4. As an NBBU member, the NBBU General Terms and Conditions for the provision of temporary workers also apply.

Article 3 - Offer and Agreement

  1. All offers and quotations from Brum & Keizer are non-binding, unless expressly stated otherwise.
  2. An agreement is concluded at the moment the order confirmation is signed by the Client, or at the moment Brum & Keizer has actually commenced the execution of the assignment.
  3. Any changes to the assignment must be communicated in a timely manner and in writing.

Article 4 - Performance of the Agreement

  1. Brum & Keizer will perform the agreement to the best of its knowledge and ability, in accordance with the standards of good workmanship.
  2. Brum & Keizer selects candidates and temporary workers based on the information about job requirements and working conditions provided by the Client.
  3. The Client is responsible for the accuracy and completeness of the information provided.
  4. Brum & Keizer has the right to engage third parties in the performance of the agreement.

Article 5 - Rates and Payment

  1. Rates are agreed in writing in advance and are exclusive of VAT, unless stated otherwise.
  2. Payment must be made within 14 days of the invoice date, unless otherwise agreed.
  3. In the event of late payment, the Client is in default by operation of law and statutory commercial interest is due.
  4. Brum & Keizer reserves the right to adjust rates in the event of changes in laws and regulations, collective labour agreement provisions or social security contributions.

Article 6 - Liability

  1. Brum & Keizer is not liable for damage caused by the Client providing incorrect or incomplete information.
  2. The liability of Brum & Keizer is limited to the amount paid out by the liability insurance in the relevant case.
  3. Brum & Keizer is not liable for indirect damage, including consequential damage, lost profit and missed savings.
  4. The Client indemnifies Brum & Keizer against claims by third parties related to the execution of the agreement.

Article 7, Privacy and Data Protection

  1. Brum & Keizer processes personal data in accordance with the General Data Protection Regulation (GDPR).
  2. For more information about our privacy policy, please refer to our Privacy Statement.
  3. The Client and Brum & Keizer take appropriate technical and organisational measures to secure personal data.

Article 8, Complaints

  1. Complaints about the execution of the agreement must be submitted to Brum & Keizer in a timely, complete and clearly described manner.
  2. Brum & Keizer aims to handle complaints within 14 working days.
  3. As an NBBU member, Brum & Keizer is affiliated with the NBBU complaints procedure.

Article 9, Applicable Law and Disputes

  1. All agreements between Brum & Keizer and the Client are governed by Dutch law.
  2. Disputes arising from or related to the agreement will be submitted to the competent court in the district of Overijssel.
  3. Parties will only resort to legal proceedings after they have made every effort to settle a dispute through mutual consultation.
